When I was a reporter in the late 1960s, most U.S. citizens were born abroad in a foreign country. At least half were immigrants, some had been in the country for many years, and most had lived here their entire lives.

When a judge rules on the question of citizenship, he must first consider two issues: (1) whether someone has become a citizen when they became naturalized, and (2) whether that citizenship should extend to the person's relationship with the government.

The Constitution and the laws of the U.S. make it very clear that people must be born in the country of their parents and live there their entire lives. If somebody is born abroad, he or she must stay there. As far as citizenship goes, U.S. law does not apply. The only things an immigrant who becomes a citizen of the United States has to do is renounce his or her U.S. citizenship and file for naturalization.

Why should I care who got my citizenship and why?

To answer that question, here are the questions we must ask to evaluate whether an immigrant in your household is a citizen.

The first is whether you and your spouse have been legally "citizen" of the United States at birth. If you are, and you have been since you were a baby, and you are not a citizen on your mother's side and your father or grandfather were, you must renounce your U.S. citizenship. You can, however, renounce your U.S. citizenship with specific, specific conditions -- to say nothing of conditions specific to your spouse's U.S. citizenship.

Some legal scholars, as you can see, are more inclined to grant an exception to the "lawful presence of parents" test when the immigrant is a child born in a foreign country. For the sake of argument, however, we will assume that your spouse has not gone on to become naturalized but has had his or her citizenship revoked.

The court will consider each of these questions with the following four parameters:

Were you both citizens at birth on June 7, 1948? If they were, then you are considered citizens as long as your parent(s) either gave birth to the child or were citizens at birth on June 7, 1948. No, your parents did not become citizens of the United States. Was it between 1946 and 1953? Then you will not be considered citizen of the United States unless your parent(s) was not citizens at birth. Yes, but there is a more detailed explanation for your "lawful presence of parents" question in the next paragraph.

WASHINGTON (Reuters) - U.S. President Barack Obama is considering lifting a temporary restraining order on the importation of so-called child labor, the Labor Department said on Monday.

White House press secretary Jay Carney said the new action was a "long-term, necessary, and very aggressive step that has to be taken and will go far in helping our workers."

"It is long past time to end the use of these unsafe conditions for children and the many other workers impacted by these practices," Carney said.

Obama's administration has been under increasing pressure from labor groups, who have said the rules have become a source of racial tension.


On Monday a group of union leaders - including the National Education Association, which represents teachers - sent a letter to Obama asking him to lift the new rules.

While the new administration is likely to consider lifting the temporary restraining order, it may also decide to impose additional regulations, including tougher enforcement of minimum wage requirements.

"We're confident that it will lead to the enforcement and regulation of the law as it has been enforced in every case," said Brian Schaffner, labor economist with the Peterson Institute for International Economics.

The Labor Department will publish regulations for the importation and manufacture of child labor on Oct. 7.

The Department of Labor said last month it would publish regulations on child labor. The U.S. Department of Commerce is considering rules on child labor as well.

Child labor is considered a labor practice under the federal Labor Non-Discrimination Act of 1979 and has been a significant source of child labor in some U.S. states that employ child laborers.

Child labor is classified as labor under a U.S. law known as the Fair Labor Standards Act.
